A bit moody:)

Hi dear guys!


Sorry I wasn't posting much - I'm not feeling quite alright... No, LOL, I'm fine and I don't have any health issues... actually it's the thinking thing that makes me sick :) I'm feeling a bit of down that I'm tied with that stupid non-compete clause and can't sell right away. Yup, less than 3 months left but... Really we're not doing very well these months (after DD's birthday which was quite an expense! LOL) and my monthly earnings were of great help to our budget. I was just wondering how could anyone prevent one from EARNING HIS LIVING?... the most stupid and heartless thing ever. Luckily I have my awesome beloved DH who earns enough for us three. Imagine a single mom in this situation?..

Now not to make you feel down with me... I've been super busy and have a whole new bunch of fresh and great stuff to go to the store in the fall! Some of them include 4-5 papers and 16-17 elements as I've promised but now I tend to create 8 papers and 25 -30 elements- yup, you can never get enough of the elements! Now worries for dial-up users - I split the zips for your faster and easier downloads! :)


And, since I'm guilty of not posting thru' the week I'm here with an elegant freebie for ya!!! It's called the Solitary Flute and it was available for sale once - now given away for your pleasure :) If you like it please leave some love - I'm soooo needing it right away! LOL thanks guys!

Irene. Thank you for your openness and honesty with your feelings. I can only imagine that this time of "waiting" is frustrating. But one time, in my own 'waiting room', I realized that God was doing some wonderful things which I would have been too busy to see at any other time. Waiting is hard when we don't see the 'why'. But just think about this time as a gift - time to re-group, think things through, create without pressure and grow. And when the window finally opens you will be fully ready for it. Thanks for your wonderful free gifts. I love your work - it is soft, beautiful and creative. Can't wait to see what develops in you during these weeks while you are "waiting". {{hugs}}

Gorgeous work as always, Irene. I about bought out your store on the last few days I could, and you still manage to find beautiful things I didn't get to buy. When you can finally sell again your store is going to be super-busy!!! It will be PARTY TIME!!!

It is ridiculous that you cannot sell. I found it strange when you mentioned in other posts that you were only gonna sell in october (?), what the heck? Well, maybe there is a good to find in this and now you have enough time to make those gorgeous kits.

Cheer Up, Irene... The 3 months will go by quickly and will give you time to create more of those fabulous kit of yours!

That clause is the major reason I never applied there as a designer. It's just plain silly. It's not like they have any trade secrets. I'm not a single mom, but still, my income, is my income and no one should have the right to deny their natural talents, whatever they may be!

Everyone is waiting for you, don't dispair... you certainly are not forgotten!

And about that non-compete - it's ILLEGAL in about 1/3rd of the states in the US. The binding rules of US employment contracts are what state the resident is in. (Well, it's a little more complicated than that, but that is what it boiled down to for me.)

So you might want to look into whether the agreement is valid where you live.

In fact, in many of the (US) states where a non-compete clause is legal, it's STILL not permissible to prevent someone from earning their living.

But, I'm not a lawyer - just been there done that and got to tell the big corporation where to stick their non-compete clause.

site anymore. You were the most talented designer there and their
rule are really unfair to you. But
you have them all beat in the talent
so, just hang on. We all love your
designs and will follow you where
ever you may go. While the other site
is giving their site a bad name.
You were much to talented to stay
there. Thank you for another wonderful kit that I was unable to
buy because $$$ is short for my family. If you ever have a CT call
I want a chance to work with you. :)

Irene - so sorry you have to wait 6 months to sell your designs, but I presume that you DID knowingly sign a non-compete clause? They are standard in many businesses in the U.S. My daughter who is a physician, also had to sign one when she went to work agreeing not to get another job within 50 miles of her current employment. I believe the point is to prevent her from "taking" patients with her. The same would be true for lawyers and sales people to prevent them from taking customers away from a business. No fun having to wait, but think of all the kits you can get ready!

I can understand your frustation. But, on a positive note, by passing out these awsome kits you are building the anticipation for those that love your work and a larger fan base. I know you will do exceptionally well in the new store. Also, it's not around Christmas time, which is what happened to me when I left the store I was selling at before opening mine. That hurt a little! I wish you all the best.

what is a competive clause? never heard of that...why aren´t you allowed to sell?
i would love to offer you your own place for your designs - at digitalscrapgirl.com (i´m the owner ) some designers are belonging to a mall, we all have our own stores and just do some collabs and activities together. so very easy going. you get your own store for just some dollars per month, no 25% etc plus an introduction - so if you like to get in touch with me write to monja@misticadesigns.com

So sorry you're having a rough time. Wish I had some marvelous words of wisdom for you, but the only thing I can come up with is a lame thing my gram used to say, "This too shall pass." How helpful is that?! It's true, but...sheesh! ;-p

Sorry to hear about the troubles about the non-compete clause - I also left you a comment at 4Shared, which was a bit more ummm, direct, I guess you could say. Unfortunately, I can't download the wonderful kit. 4-shared keeps giving me an error message. I'll keep trying, and you keep your chin up. Plus, you know it's gotta piss 'em off that your giving all the kits that you were selling there away for free. HAHAHAHAHAHAHAHAHAHAHA. You're not competing, and yet you are growing your fan base. The other site is so full of cliques, it's always the same old people winning everything anyways, so I've completely giving up. I guess I' just not one of the popular kids. LOL. YOU GO GIRL!! You'll be back in business in October with a new fan base, a new site (which looks like a GREAT site btw) and you'll be better than ever!! This digi-chick is rooting for you, and I know many others are too. Keep your head up girl!!

Second -- on the non compete clause-
THAT is so WRONG on so many different levels and knowing the site that is using it just stunned me! I have rarely shopped there and will NOT be shopping there again knowing that they would stoop so low as to prevent a designer from earning money. NONE of us makes enough to live on scrapping alone as it is and to find a site that is so blatently against their designers leaving and making money elsewhere just stinks! Sorry but that is my opinion! You hang in there and don't let it get you down! You have your own following and it seems to be growing daily! Sending you cyber hugs and well wishes!
